Colorado Compliance Boundary (CADA & 303 Creative)

This document is structurally aligned with Colorado laws. Under the Colorado Anti-Discrimination Act (CADA), you may never deny service based on a client's identity or protected characteristics. However, under the U.S. Supreme Court decision in 303 Creative LLC v. Elenis, 600 U.S. 570 (2023), custom apparel screen printing constitutes an expressive artistic medium. You retain the absolute right to refuse to create, alter, or design custom text or artwork that conflicts with your sincerely held religious Christian convictions or standard decency rules, provided your refusal applies identically to all individuals regardless of background.

1. Expressive Design & Content Review Policy

Columbine Copy & Apparel operates as an expressive custom design and printing studio. Every apparel item we produce requires our active artistic engagement, machine calibration, and creative layout coordination. In accordance with federal constitutional law and the United States Supreme Court precedent established in 303 Creative LLC v. Elenis, 600 U.S. 570 (2023), we reserve the absolute right to control our creative tools and decline the creation of custom text, graphics, or messaging that conflicts with our deeply held religious convictions and Christian faith.

All custom orders are subjected to a rigorous content and design review prior to printing. We reserve the absolute right to decline production on any requested artwork, text, or design layout that we determine, in our sole discretion, contains vulgarity, profanity, crude anatomical depictions, targeted harassment, or concepts that violate our foundational ethical and faith-based parameters.

We strictly abide by the Colorado Anti-Discrimination Act (CADA). We do not discriminate, deny service, or turn away clients based on race, creed, color, national origin, sexual orientation, gender identity, or any other legally protected characteristic. Our service reviews are directed exclusively at the expressive content and requested messaging of the custom artwork itself.

2. Intellectual Property & Client Indemnification

The Client assumes 100% legal responsibility for all text, images, logos, and graphics uploaded to our portal. By submitting an order, the Client explicitly warrants that they possess undisputed lawful ownership, valid trademark registration, or written copyright licensing permissions for every element within the artwork.

We will not print unauthorized copyrighted materials, professional sports team logos, corporate branding, or celebrity likenesses. To print protected material, the Client must upload formal, verifiable written approval from the appropriate governing organization or trademark holder prior to production.

The Client agrees to fully indemnify, defend, and hold harmless Columbine Copy & Apparel from any and all financial liabilities, copyright infringement lawsuits, statutory damages, or legal fees arising from our printing of artwork provided by the Client.

3. Artwork Accuracy & Production Timelines

The Client is solely responsible for proofreading all uploaded text, names, phone numbers, spelling, and dates. If the finished apparel accurately matches the artwork file uploaded by the Client, no refunds or reprints will be issued for spelling errors or design mistakes.

Most standard orders are processed, printed, and completed within 10 business days or less from the date of final artwork approval. This timeline represents in-shop production time and explicitly excludes transit/shipping windows to the customer.

Apparel availability fluctuates across national warehouses. In the event that a chosen garment size, color, or fabric blend is backordered or unavailable, Columbine Copy & Apparel will promptly contact the Client to discuss alternative garment brands or adjustments.

4. Cancellation, Fees, and Refund Rules

Because we initiate graphic setup and supply procurement immediately upon order placement, no changes or modifications to the order can take place once submitted. Any emergency modifications requested after submission may incur steep structural processing charges.

If an order is canceled at the Client's request prior to ink hitting the garments, a 35% restocking fee will be strictly withheld from the total order refund to cover administrative setup, file optimization, and garment shipping returns.

If an order is declined by our design team due to copyright issues, vulgarity, or ideological content violations, a refund will be issued. To protect our shop from external card processing costs, all refunds issued due to Client content or copyright violations will be issued minus the non-refundable credit card processing fees incurred by the payment network.

All authorized financial refunds are initiated and executed via Square processing software. Refunds will be delivered exclusively according to Square's standard processing timelines, terms, and bank clearing windows.

5. Post-Delivery Inspection Period

Within three (3) calendar days of physical receipt of the apparel order, the Client understands and agrees that they must thoroughly inspect all garments for manufacturing defects, misprints, or quantities. Any claims regarding misprints, physical damage, or printing errors must be submitted in writing with photographic proof within this 3-day window.

Failure to notify Columbine Copy & Apparel within 3 days constitutes a final legal acceptance of the order, and no subsequent refunds or adjustments will be permitted.
